Planning laws in Spain are complex; it is important to remember that planning regulations vary greatly from one municipality to another, and great care should be taken to ensure that any proposed project is defined according to the correct guidelines. With this in mind we, at ACP Arquitectura, work closely with local town halls, provincial and environmental authorities to ensure the smooth running of all our projects.Building Licences & PermitsThere are a variety of licences or ‘certificados’ which may need to be obtained from the local town hall (ayuntamiento), provincial government (e.g. Junta de Andalucía) or from the various official bodies controlling environmental concerns, depending on the nature of the construction or renovation project. Each will require some supporting documentation and/or architects´ plans in order to be considered and we endeavour to keep ourselves up-to-date with the current legislation to process our applications as efficiently as possible.A ‘Licencia de obras’ covers a ‘minor works’ project, whereas an 'obra mayor' characterises more substantial work. A further permit would be required in the event that a skip, building materials or equipment are to be placed outside of the site boundary, effectively occupying the public highway. Once a property has been built or renovated there are procedures to be followed in order to connect utilities to the property, i.e. water and electricity and to be able to be occupy the building. These include:Licencia fin de Obras – Certificate of End of Building WorksCédula de habitabilidad/Licencia de primera ocupación – Licence to occupy Seguro Decenal – Guarantee Insurance of new buildingsAt ACP Arquitectura we keep constant track of the progress of our projects in order to ensure there are no unnecessary delays at any stage of the building and its subsequent occupation.Land Classification Property types in Spain generally fall into one of two planning regulation categories, namely ‘suelo urbano’ (urban plots) and ‘suelo no urbanizable’ (rural plots). Those plots classified as 'suelo urbano' relate to plots which are situated in a zone designated for housing development. This does not necessarily mean an 'urbanización'; it merely refers to urban living, be it in a city, a town, a village or a specifically designated Spanish Urbanisation within one of the former. Rural plots in Spain are generally subject to very stringent, and indeed complex, planning regulations as they have not been classified as having permission on which to build residential properties; ergo any development is severely restricted.ACP Arquitectura have a wealth of experience in the planning application procedures of both urban and rural plots and are constantly keeping ourselves up-to-date with the ever-changing planning regulations in Spain and particularly the planning regulations pertinent to the Province of Granada. We liaise with planning officers in the local municipality, provincial government and environmental agencies, where necessary, of a project site to determine the building possibilities, viability and the exact classification of a property or plot of land prior to its purchase or the application for the required building permit (licencia/permiso de obra).
